Nektar maintains the new-tar.ch website (“web site”) as a courtesy to those who may choose to access the web site. By using the web site and other services offered by Nektar, you are agreeing to be bound by the following Terms and Conditions. These Terms and Conditions cover all visits of the web site and potential, present and future membership features provided by Nektar, individually and collectively referred to as the “Service”. These Terms and Conditions do not cover the use of the Nektar Terminal or the Services offered to members of the International Business Consortium (IBC) which are provided separately.

If you are agreeing to these Terms and Conditions on behalf of a company or another legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access the Service through your account to these Terms and Conditions. Nektar grants you permission to visit the web site and to download and copy the information, documents and materials from the web site for your personal, non-commercial use, without any right to resell or redistribute them or to compile or create derivative works therefrom, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific the content of the web site.

The Nektar web site may contain links and references to third-party websites. The linked web sites are not under the control of Nektar, and Nektar is not responsible for the content of any linked web site or any link contained in a linked web site. Nektar provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked web site by Nektar.

No Endorsement or Association
You may not represent or imply that Nektar is participating in, or has sponsored, approved or endorsed the manner or purpose of your use or reproduction of the information in this Site. You may not use the name, emblem, or official seal of Nektar or any abbreviation of the name of Nektar, without the prior written approval of Nektar. Nektar will prosecute, to the fullest extent of the law, any person who does not comply with this paragraph. 

 

Limited Warranties and Liability
Nektar cannot make any warranty about the reliability of the Service or guarantee the security of user data, despite best efforts. The Service is provided “as is” and you agree to not hold Nektar responsible nor to seek indemnification for any damages that may arise as a result of the loss of use, data, or profits connected to the performance of the Service or failure in such performance. Furthermore, you will not hold Nektar liable or seek indemnification if confidential material is unintentionally released as the result of a security failure or vulnerability in the performance of the Service. We may make improvements and changes to the Service at any time without notice. Nektar may at its sole discretion, terminate service without cause or notice.

You agree that Nektar, and any parents, subsidiaries, officers, employees, or third party contractors cannot be held responsible for any third party claim, demand, or damages, including reasonable attorneys’ fees, arising out of your use of this Service.

Our Privacy Policy explains the way we handle and protect your personal data and privacy in relation to your use of the Service and your browsing of the net-tar.ch web site. By agreeing to the present Terms and Conditions and to be able to use the Service, you also agree to our Privacy Policy.

Applicable Law
This Agreement shall be governed in all respects by the substantive laws of Switzerland. Any controversy, claim, or dispute arising out of or relating to the Agreement shall be subject to the jurisdiction of the competent courts of the Canton of Zurich, the jurisdiction of the Swiss Federal Court being expressly reserved.
